Terms of Service

1. Who we are

SitePets is a service operated by ManuSoft Inc, a corporation organised in the United States, doing business as “SitePets” (“SitePets”, “we”, “us”). These terms are an agreement between ManuSoft Inc and you. You can reach us at [email protected].

By pasting the Snippet on a website, creating an account, Claiming a Pet or making a purchase, you agree to these terms. If you use SitePets for a business, you agree on behalf of that business.

2. What SitePets is

SitePets gives a website (a “Site”) a small animated creature (a “Pet”) that appears on the Site’s pages through one line of code (the “Snippet”). A Pet’s look reflects whether the Site’s homepage answers and how its page loads compare with its own usual level, and Pets also appear in a shared public space (the “World”).

Every Pet is a Common Pet, free of charge with no time limit. You may also buy a yearly Adoption of a rarer Species, which changes only how your Pet looks. It doesn’t change how your Site is checked.

3. Your Site and the Snippet

• You may only add the Snippet to a Site you control or are authorised to change.
• You are responsible for your Site, including telling your visitors about SitePets where the law requires it. Our What the Snippet does page describes exactly what it does and offers a paragraph for your privacy policy.
• When the Snippet runs on your Site, we process data on your behalf as your processor under our Data Processing Agreement, which forms part of these terms.
• We check your Site’s homepage automatically, with a crawler that identifies itself as SitePetsBot, to confirm the Snippet is installed (“Verification”) and whether the homepage answers.

4. Accounts and Claiming

You sign in with a link or a code we send to your email address, or with Google. Keep access to that email secure: anyone who can read it can sign in. A Pet on a Site that hasn’t been Claimed by an account may be removed after 7 days.

5. Adoptions

An Adoption is a yearly, automatically renewing purchase of a paid Species for one Pet. Prices are shown in US dollars and include any sales tax or VAT that applies.

Payments are processed by Link, a Stripe company, which sells the Adoption to you as merchant of record. Link’s own terms apply to the payment, the receipt and the handling of sales tax and VAT. We don’t receive or store your card details.

Your year

The charge at checkout pays for your first year, which starts the day you pay. Your Adoption then renews automatically every year on that date, at the price shown at checkout, until you cancel. If we ever change the renewal price, we will email you at least 30 days before the renewal it applies to, and you can cancel before then.

Each Pet hatches a day after we first find the Snippet on its Site’s homepage. If you adopt before then, your Pet shows that Species’ egg until it hatches. If it has already hatched, it changes to that Species straight away. Either way, your year starts on the day you pay.

Pre-Adoptions

If your receipt says your first year starts at hatch on January 12, 2027, you bought a Pre-Adoption, and it keeps the terms you bought it on. Your first year ends on January 12, 2028, when it first renews. Your Pet now hatches a day after we find the Snippet, which may be earlier; that doesn’t change your dates or your charge. We will offer you the choice of a full refund or moving to the terms above, and nothing changes until you choose.

Cancelling

You can cancel renewal at any time. Your Pet keeps its Species until the end of the year you paid for. If a renewal payment fails, we and Link will retry it for up to 30 days. If it still hasn’t been paid after those 30 days, the Adoption ends.

6. Refunds

• Adoptions: your year starts on the day you pay, so payments are not refundable, except where the law requires a refund or Link grants one.
• Pre-Adoptions: you can get a full refund of what you paid at any time before January 12, 2027, with one click in your dashboard. If SitePets isn’t live by January 12, 2027, we will refund every Pre-Adoption in full automatically. You don’t need to ask. After January 12, 2027, the rule for Adoptions applies.

When an Adoption is refunded, or a payment is disputed or charged back, the Adoption ends at once. Your Pet goes back to its Common Species and the paid Species stays reserved on your account, so a new Adoption can restore it.

Nothing in these terms limits any right you have under the consumer protection laws of the country where you live.

7. Acceptable use

Don’t use SitePets on Sites that serve malware, phishing or illegal content, and don’t interfere with the service, for example by sending fake beacons or overloading it. We review Sites before their Pets appear in the World. We may keep a Site out of the World, and we may stop showing the Pet on Sites that serve malware, phishing or illegal content. If that ends a paid Adoption early for reasons that aren’t your fault, we refund the unused part.

8. Our service

We build the Snippet so that if something goes wrong on our side, your page shows no Pet and is otherwise unaffected. SitePets is not a monitoring or alerting service you should rely on for your business. We provide it “as is” and “as available”, without warranties of any kind, to the extent the law allows.

The Pets, artwork, names and software are ours or our licensors’. We give you a personal, non-transferable licence to display your Pet on your Site while you use SitePets under these terms.

9. Limitation of liability

To the extent the law allows, ManuSoft Inc is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from SitePets. To the extent the law allows, our total liability for any claim about SitePets is limited to the greater of the amount you paid us for SitePets in the 12 months before the claim arose, or US$50.

These limits don’t apply where the law doesn’t allow them, including liability for death or personal injury caused by negligence, for fraud, or, for consumers in the EU and UK, for intent and gross negligence.

10. Ending these terms

You can stop using SitePets at any time by removing the Snippet. We may suspend or end your use if you break these terms. If we ever shut SitePets down, we will give at least 30 days’ notice by email and refund the unused part of any paid Adoption.

11. Changes

We may update these terms. For changes that matter, we will email account holders at least 30 days before they take effect. If you keep using SitePets after that, the new terms apply.

12. Law and disputes

These terms are governed by the laws of the US state in which ManuSoft Inc is incorporated, without regard to its conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in its courts.
